1. ACCEPTANCE OF TERMS

By accessing and using Apexminds ("the App"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use this service.

2. DESCRIPTION OF SERVICE

Apexminds is a mental health and wellness application designed to help users track their mood, journal their thoughts, access AI-powered mental health support, and utilize various wellness resources. THE APP IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

3. ELIGIBILITY

You must be at least 13 years old to use this App. By using the App, you represent and warrant that you meet this age requirement.

4. USER ACCOUNT

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• You agree to provide accurate and complete information when creating your account

6. USER CONDUCT

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to any part of the App
• Interfere with or disrupt the App or servers
• Upload malicious code or content
• Impersonate any person or entity
• Harvest or collect user information without consent

7. INTELLECTUAL PROPERTY

All content, features, and functionality of Apexminds, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Apexminds and are protected by international copyright, trademark, and other intellectual property laws.

8. USER-GENERATED CONTENT

• You retain ownership of content you create (journal entries, mood logs, etc.)
• You grant us a limited license to store and process your content to provide the service
• You are solely responsible for the content you create

9. SUBSCRIPTION AND PAYMENTS

• Some features require a paid subscription
• Subscriptions auto-renew unless cancelled
• Refunds are handled according to App Store/Google Play policies
• We reserve the right to change pricing with notice

10. TERMINATION

• You may delete your account at any time through the app settings
• We may terminate or suspend your account for violations of these terms
• Upon termination, your right to use the App ceases immediately

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APEXMINDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

12. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. INDEMNIFICATION

You agree to indemnify and hold harmless Apexminds and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these terms.

14. GOVERNING LAW

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.

15. CHANGES TO TERMS

We reserve the right to modify these terms at any time. We will notify users of significant changes via the App or email. Continued use of the App after changes constitutes acceptance of the new terms.
